Summary of the House Committee Version of the Bill

HCS SB 1023 -- DNA PROFILING ANALYSIS

SPONSOR:  Gibbons (Johnson, 61)

COMMITTEE ACTION:  Voted "do pass" by the Committee on Crime
Prevention and Public Safety by a vote of 13 to 0.

This substitute defines "central repository" and "forensic DNA
analysis" and allows a person determined to be actually innocent
of a crime to receive $50 for each day of post-conviction
incarceration and an automatic expungement of any records
concerning the crime for which the person was innocent.

The substitute also extends the expiration date on criminal court
surcharges from August 28, 2006, to August 28, 2013.

FISCAL NOTE:  Estimated Effect on General Revenue Fund of a Cost
of Unknown to an Income of $576,922 in FY 2007, a Cost of Unknown
to an Income of More than $702,124 in FY 2008, and a Cost of
Unknown to an Income of More than $702,124 in FY 2009.  No impact
on Other State Funds in FY 2007, FY 2008, and FY 2009.

PROPONENTS:  Supporters say that the DNA Testing Fund has been
used as a source of money to pay restitution to those individuals
who have been determined to be innocent of the crimes for which
they were incarcerated.  The fund was recently depleted.  The
bill will establish procedures to administer the fund more
efficiently.

Testifying for the bill were Senator Gibbons; Missouri Catholic
Conference; and State Highway Patrol.

OPPONENTS:  There was no opposition voiced to the committee.
